To sell the idea to the court, Trump invoked a 1977 emergency powers law, which was meant for sanctions, not trade wars, to declare trade deficits a "crisis" and hammer erstwhile allies like Canada, Mexico, China, and everyone else with duties Trump fundamentally misunderstands trade deficits, and he's been peddling the same wrongheaded take for decades: that a trade deficit is automatically a "loss," like America is getting ripped off in a zero-sum game where money flows out and nothing comes back. They have always been a stupid and unpopular idea, especially now with the country in the midst of an affordability crisis. Even libertarian and pro-business GOP groups lined up against them. And for good reason: the economic stupidity is staggering. The CBO estimates Trump's tariffs would cost the economy $3 trillion over the next decade. The Treasury has already collected $133 billion from these duties, but now companies like Costco are lining up to demand refunds. Small businesses, from plumbing suppliers to toy merchants, sued, arguing the emergency powers law never even mentions tariffs. They won, and no doubt want their money back too. Guess those $2,000 checks for every American will have to wait. This is a humiliating rebuke to Trump's executive power grabs, and a great victory for the average American. For all its obeisance, the court thankfully drew the line at Trump's tariff boondoggle just because it's so dumb. Declaring trade imbalances an "emergency" only jacked up costs for Americans and alienated allies, finally putin a knife to the heart of Trump's most baffling and ill-considered obsessions.
